Our Internet Acceptable Use Policy is as follows.  

Norvado strives to provide all of its customers with the highest quality Internet service available, while adhering to Internet use policies established by the Internet Community and State and Federal Laws. 

Norvado’s (“Provider”) Acceptable Use Policy (“AUP”) covers all of its Internet Products and Services (“Services”) and is designed to help improve the use of the Internet by preventing unacceptable use.  All users of the Services must comply with this AUP. 

Use of the Services constitutes acceptance of the AUP. Customer is responsible for all use of the Services, including by End Users and third parties who access the Services via Customer’s facilities, credentials, or devices. Users are solely responsible for any and all acts and omissions that occur while accepting the Services, and users agree not to violate the AUP or engage in any unacceptable or illegal activities while utilizing any of the Services. Provider may, in its reasonable discretion, with or without notice, suspend, restrict, or terminate Services, remove or disable access to Content, block traffic, rate-limit, or apply filtering where Provider determines that Customer or its End Users have violated this AUP or where necessary to protect the network, other customers, or comply with law or a third-party right. The Provider further reserves the right to terminate service to any user without notice upon violation of any part of the AUP. Where practicable and lawful, Provider will provide notice and an opportunity to cure; however, immediate action may be taken for threats to safety, security, network integrity, or legal compliance. 

The Provider reserves the right to revise, modify and amend this AUP at any time and in any manner.  Notice of any revision, modification or amendment of the AUP will be posted on the Provider’s website at www.norvado.com. Continued use after the effective date constitutes acceptance. 

As a Customer utilizing the providers’ Internet service, you agree to not use the service for or in the pursuit of illegal activities as noted below.   You also agree to not directly or indirectly allow a third party to use the service in an illegal or unsuitable manner as determined by the Provider.  The Provider may take action against users for violating these policies; including removing any content that violates the AUP and/or terminating use of the Services.  The Provider reserves the right to investigate any violations of this AUP.  The Provider may cooperate with legal authorities at the Local, State, and Federal level and/or third parties in the investigation of suspected or alleged criminal or civil violations.  The Provider may also cooperate with the System Administrators of the Internet Community to enforce this AUP.  Customer must promptly cooperate with Provider’s investigation of AUP issues, including provision of logs, contact information, and access to impacted devices, to the extent that such information and access are within Customer’s control and may be disclosed or provided under applicable law. Customer is responsible for Provider’s reasonable costs of investigation, mitigation, filtering, and remediation attributable to Customer’s verified AUP violations. 

Inappropriate Content

Users may not upload, download, post, email, distribute, publish or otherwise transmit (collectively “Transmit”) any message, data, information, image, text, song, movie or other material (collectively “Content”) that is determined in the sole discretion of the Provider to be unlawful, libelous, slanderous, threatening, abusive, harassing, defamatory, vulgar, obscene, pornographic, indecent, invasive of privacy or publicity rights, inflammatory or otherwise harmful or offensive to third parties. Provider does not monitor Content but may remove, disable, or block access to Content in its reasonable discretion if and when the Provider becomes aware of the Content. 

Abuse of Electronic Mail 

The Services may not be used to send unsolicited bulk or commercial email (spam). Activities that facilitate spam are prohibited, including harvesting addresses, using open relays, or purchasing lists without affirmative consent.  

Without Provider’s written approval Customer shall: (a) not send the same or substantially similar message to more than 50 unique recipients within 24 hours; and (b) shall not exceed 1,000 outbound emails per hour per account or mail server, inclusive of retries and bounces. All bulk emails must be opt-in, include accurate headers, a functioning unsubscribe, and be sent only to recipients who have provided verifiable consent. Upon violation, Provider may suspend outbound mail, require remediation, and recover reasonable mitigation costs.  

Network Security/Integrity 

Using the Services for any activity which adversely affects the ability of other people or systems to use Services or the Internet is prohibited.  This includes Denial of Service (DoS) attacks, Virus Uploading and Distribution, and Hacking (intentional, unauthorized access into a service or system without express authorization). Prohibited activities include DoS/DDoS, malware distribution, unauthorized access or scanning, port scanning without authorization, traffic amplification/reflection abuse, botnet operation, and use of anonymization to evade AUP enforcement. Customer shall use commercially reasonable efforts to maintain the security of devices connected to the Services, including installation of software updates, use of current anti-malware protections where applicable, and implementation of appropriate account security measures. Providers may filter, rate-limit, or block traffic to preserve network security or mitigate ongoing attacks. 

Resale, Sharing, and Distribution 

Users may not resell, share, or otherwise distribute the Services or any portion thereof to any third party without written consent of the Provider. For example, you may not provide Internet access to others through any Provider Internet service (“Piggybacking”), host shell accounts over the Internet, provide email or news services, or send a news feed. 

Illegal Use 

Users may not Transmit Content that intentionally or unintentionally violates any applicable, known, or unknown, local, state, national or international law. Provider may immediately disable access and preserve/disclose information as required by law. 

Harm to Minors 

Users may not make information available to minors in violation of federal or state law or use the Service to harm or attempt to harm minors in any way. 

Forgery or Impersonation 

Users may not impersonate any person or entity, including, but not limited to, an employee or officer of the Provider, forum leader, guide, or host, or falsely state or otherwise misrepresent your affiliation with a person or entity. Forging headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the Provider is prohibited. Accessing or attempting to access others’ accounts or systems without authorization is prohibited. 

Fraudulent Activity 

Users may not make fraudulent offers to sell or buy products, items, or services or to advance any type of financial scam such as “pyramid schemes,” “Ponzi Schemes,” or “chain letters.” 

Unauthorized Access 

Users may not use the Services to access or attempt to access the accounts of others, or to penetrate or attempt to penetrate security measures of the Service Provider’s or other entity’s computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data. 

Users may not attach any devices or utilize any applications used to access unauthorized or pirated content, create automated, abnormal, or malicious traffic and that may compromise the security or integrity of the network.   

Collection of Personal Data 

Users may not use the Services to collect, or attempt to collect, personal information about third parties without their knowledge or consent. 

Infringement of Intellectual Property Rights 

The Provider does not permit users to transmit, access, distribute, facilitate, promote, or engage in activities concerning any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party as specified by the Digital Millennium Copyright Act (DMCA) of 1998 or any other applicable law. This includes, but is not limited to, the unauthorized copying of copyrighted materials, the distribution of photographs from magazines, books or other copyrighted sources and the unauthorized transmittal of copyrighted software, music and/or movies, the use of unauthorized streaming or video services and the distribution, promotion, sale or operation of devices, software or services designed primarily to circumvent any copyright protections or facilitate copyright infringement.  

As governed by the DMCA Act of 1998 Section 512, the user will be removed from the Provider’s network for repeated infringement of copyrighted materials.

The Provider requests that anyone who believes that there is a violation of this AUP send that information to info@norvado.com. 

THE SERVICES AND ANY SECURITY/ABUSE CONTROLS ARE PROVIDED ‘AS IS’ WITHOUT WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROVIDER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR LOST PROFITS, ARISING OUT OF OR RELATED TO THIS AUP OR THE SERVICES. PROVIDER’S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THIS AUP SHALL NOT EXCEED THE AMOUNTS PAID BY CUSTOMER FOR THE SERVICES IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY. Customer will defend, indemnify, and hold harmless Provider and its affiliates against claims, losses, and expenses (including reasonable attorneys’ fees) arising from Customer’s or its End Users’ violation of this AUP or infringement of third‑party rights.
